Taking FMLA Leave for Rehab: A Guide to Job-Protected Leave

You may have already decided you need help. What keeps you from calling is your job. Who at work will find out, and will your role still be there when you come back? If you are a spouse or parent looking into this for someone you love, the same questions apply on their behalf. FMLA for rehab is a real option, with clear federal rules on who qualifies and what it protects. Outpatient care can also shrink how much time away you need.

Twelve Weeks of Leave and the Three Tests to Qualify

The Family and Medical Leave Act gives eligible employees up to 12 workweeks of unpaid, job-protected leave in a 12-month period. Your group health coverage continues on the same terms, and you keep paying your usual premium share. Eligibility takes all three of these:

  • At least 12 months with your employer, consecutive or not.
  • At least 1,250 hours worked in the past 12 months.
  • A worksite where your employer has 50 or more employees within 75 miles.

When you return, you go back to the same job or an equivalent one. If your job would have been cut in a layoff anyway, FMLA does not protect it. Certain highly paid salaried employees also face a narrow exception. This is not legal advice, so check your situation through HR or an employment attorney.

Can You Use FMLA for Rehab?

Substance use and mental health conditions can both qualify as a serious health condition under FMLA. The law protects time spent receiving care from a health care provider.

FMLA for Drug Rehab and Alcohol Rehab

Federal regulation allows leave for substance use treatment by a health care provider or a provider they refer you to. The rule makes no distinction between alcohol and other drugs, so FMLA for alcohol rehab follows the same test. What FMLA does not cover is missing work because of the substance use itself. Calling out after a night of drinking does not qualify.

Your employer may have a substance use policy that applies to everyone and was shared with all staff. If so, it can still act under that policy during your leave. It cannot retaliate against you for taking FMLA leave to get care. Read your employee handbook or ask HR before you request time off.

FMLA for Mental Health Treatment

A mental health condition can qualify on the same terms as a physical one. It must involve inpatient care or continuing treatment by a health care provider. Chronic conditions with episodic flare-ups can meet that standard. Clinical psychologists and clinical social workers count as health care providers, along with physicians. Using FMLA for mental health treatment depends on more than a diagnosis.

Leave by the Hour With Intermittent or Reduced-Schedule FMLA

FMLA leave can come in pieces. When it is medically necessary, you can take it in separate blocks, called intermittent leave. A reduced schedule is the other option, with fewer working hours per day or week. Both apply to planned treatment.

Only the time you miss counts against your 12 weeks. Your employer tracks it in increments no larger than one hour. That changes how FMLA for rehab adds up. A few hours of programming a day uses leave far more slowly than a full absence. In return, make a reasonable effort to schedule planned care so it does not unduly disrupt work.

How Much Time Off Work Each Level of Care Requires

Our PHP is the most structured level we offer. Under federal definitions, PHP means 20 or more hours a week, so it may require full- or reduced-schedule leave. IOP means 9 or more hours a week under those same definitions.

Our Evening IOP meets in person and is designed for clients who work or go to school full time. Depending on your job, it may require little or no leave. Standard outpatient is the lightest level. IOP can follow PHP once your stability improves. A clinical assessment decides which level fits you right now.

How to Request Leave and Provide Medical Certification

Planned care calls for at least 30 days’ notice. If that is not possible, give notice as soon as practicable, which generally means the same or next business day. You do not have to say “FMLA” the first time you ask. You do need to give enough information to demonstrate the leave may qualify. Follow your employer’s usual call-in procedures, too.

Your employer may ask for medical certification from your health care provider. It may use an optional form such as WH-380-E. You have 15 calendar days from the request to return it. If anything is incomplete, your employer must say in writing what is missing. You then have 7 calendar days to correct it.

Who at Work Sees Your Medical Paperwork

Your employer must keep FMLA medical records in confidential files, separate from your regular personnel file. Supervisors hear only about work restrictions or accommodations. Your direct supervisor is not allowed to contact your provider. You do not have to share your diagnosis, either. The employer can request only what the certification requires to decide whether the leave qualifies.

Not Eligible for FMLA? Where Else Protected Time Off Can Come From

Accrued paid time off or sick leave is the first resource to check. It can also run alongside FMLA leave, by your choice or your employer’s requirement. Your employer’s own leave policies may cover time FMLA does not.

Georgia has no state short-term disability program. So short-term disability pay depends on a policy through your employer or one you carry yourself. Whether a policy covers substance use or mental health care varies. Leave can also be a reasonable accommodation under the Americans with Disabilities Act. That is worth raising with HR along with an employment attorney.

Common Questions About FMLA and Drug Rehab

Leave rules extend beyond your job to caregiver leave, Georgia law, insurance, and who can access your records.

Can I take FMLA leave to care for a family member in treatment?

Yes, if you are eligible and the person is your spouse, parent, or child. That includes a family member in substance use treatment, and your employer cannot act against you for providing that care. An adult child qualifies only if a disability leaves them unable to care for themselves. Care includes psychological comfort and reassurance, along with physical help.

Does Georgia have its own family leave law on top of FMLA?

For most private-sector workers, no. The state does not layer its own family leave law on top of FMLA. The federal rules work the same way in Georgia as they do in every other state. For anything beyond FMLA, check your employer’s handbook and ask HR what it offers.

Can my employer get my records from the treatment program?

In most cases, no, not without your written consent. Federal privacy rules give substance use treatment records their own layer of protection. Under those rules, a provider generally needs your consent before sharing those records with an employer. Before you sign any release, ask exactly what it would share and with whom.

Can I use my employer health plan for Emerge’s outpatient programs while I’m on leave?

You may be able to. We work with PPO, POS, EPO, and HMO plans, and private pay is also an option. We do not accept Medicaid or Medicare. Our admissions team reviews your coverage and walks you through your options before your first day.

Can my family take part in my care while I’m on leave?

Yes, we offer family and couples counseling at every level of care, including PHP, IOP, Evening IOP, and outpatient. Time away from work, or a lighter schedule, can give the people closest to you room to take part. Tell our admissions team who you want involved, so family work is part of your care plan from the start.
